Will vs living transfer

A will and a living transfer both pass property to your family, but they work very differently. A will takes effect after death and still needs probate; a living transfer moves ownership now, property by property.

Frequently asked questions

Straight answers to the questions families most often ask VL Legacy Solutions about estates, wills and property transfers in Malaysia.

How long does pusaka take in Malaysia?

It depends on the route and how complete the documents are. A small estate application through JKPTG often takes around 6 to 12 months, while a Grant of Probate or Letters of Administration through the High Court can take from several months to over a year. VL Legacy Solutions prepares the paperwork carefully to avoid unnecessary delays.

What happens to an estate without a will?

When a non-Muslim in Peninsular Malaysia dies without a will, the estate is shared according to the Distribution Act 1958, and the family must first obtain Letters of Administration or a small estate distribution order before assets can be released. For Muslims, distribution follows Faraid. VL Legacy Solutions guides families through the right application from start to finish.

Can I transfer my house to my child while I'm alive?

Yes. A living transfer, often called pindah milik kasih sayang (transfer for love and affection), moves the property to your child now instead of through a will later. It involves Borang 14A, a stamp duty assessment by LHDN, CKHT filing and registration at the Land Office. Transfers between parents and children may qualify for stamp duty exemption under current rules.

What is a small estate?

In Malaysia, a small estate is a deceased person's estate that includes land or other immovable property and has a total value of not more than RM5 million. It is handled by the estate distribution unit of JKPTG instead of the High Court, which is usually simpler and less costly. VL Legacy Solutions can check whether your family's case qualifies.

Do you serve clients outside Perak?

Yes. VL Legacy Solutions is based in Kampar, Perak, and helps families across Malaysia. Much of the work, from document checks to progress updates, can be handled by WhatsApp, phone and email, and meetings can be arranged when needed. Some steps must be done at the Land Office or court where the property or case is located, and VL explains these in advance.

Which languages do you work in?

VL Legacy Solutions works in English, Mandarin Chinese and Bahasa Malaysia. Founder Vivien Cheah Kit Wan explains procedures, forms and documents in the language your family is most comfortable with, so everyone understands each step before signing anything. Forms submitted to government offices stay in their official language, usually Bahasa Malaysia or English.

What documents do I need to start an estate application?

Usually the death certificate, the identity cards of the deceased and the heirs, documents showing family relationships such as birth and marriage certificates, the original will if there is one, and details of assets and debts such as land titles, bank statements, EPF, shares and vehicle grants. VL Legacy Solutions gives you a checklist tailored to your family's case.
